GIG BOSS PRIVACY POLICY

Gig Boss LLC (GIG BOSS) is committed to protecting and respecting your privacy. GIG BOSS offers a mobile application (the App) that allows you to communicate with your friends, workers, and colleagues about job opportunities for artistic groups, among other functions. This Privacy Policy explains our practices regarding the collection, use, disclosure, and protection of information GIG BOSS collects through your use of the App, as well as your choices regarding the collection and use of such information.
1. How Gig Boss Collects and Uses Information
Accounts and Billing Information. When you create an account through the App, GIG BOSS may collect personal information such as your username, first and last name, e-mail address(es), residential and/or business addresses, website(s), social media account(s), contacts and/or address books, phone numbers, and/or a photograph (if you choose to have a photograph associated with your account). If you choose to link your account with other friends, workers, or colleagues that also have accounts with the App, GIG BOSS may also collect and cross-reference your information with those of your friends, workers, and colleagues and those of their friends, workers, and colleagues.
GIG BOSS uses this information to establish your account with the App and ensure its core functionality and operations. Using information from your contacts and/or address books, GIG BOSS may ask you to identify prospective users of the App and for permission to individually contact and/or solicit those prospective users regarding the App. GIG BOSS will not collect, use, or disseminate information from your contacts and/or address books for any other purpose. Under no circumstances will GIG BOSS collect information from your contacts and/or address books to build a customer database for its own use or for sale or distribution to others.
In the event GIG BOSS offers you premium or value-added services in connection with the App, GIG BOSS reserves the right to request and collect billing information from you for those services. GIG BOSS uses this information to ensure proper payment for services.
Messages and User Content. If you use the App to communicate with your friends, workers, or colleagues, GIG BOSS may collect those communications and/or information relating to those communications. GIG BOSS may also retain any messages you send to GIG BOSS through the App or the GIG BOSS website.
GIG BOSS uses this information to operate, maintain, and support the features and functionality of the App; to facilitate communications between you and other users of the App; and to provide information to you about the App and its features.
To promote or facilitate your use of the App, GIG BOSS may communicate with you by e-mail; telephone; text messaging; instant messaging; and/or push notifications on your device(s). By purchasing and/or using the App, you accept and agree to such communications.
Information Collection. When you use the App, GIG BOSS and/or its business affiliates may collect information about you and/or your device through direct requests or through passive tracking technologies, including cookies, log files, and/or embedded scripts. GIG BOSS may use this information to improve the App or to support advertising through the App. In particular, GIG BOSS may collect information about the device you use to access the App, including its operating system, telephone number, and any unique identifiers associated with your device. With your permission, GIG BOSS may access your photos, contacts, and/or address books. GIG BOSS may collect analytics data or use third-party analytics tools to measure traffic and usage trends for the App and better understand the needs of its users.
GIG BOSS may use this information to operate, maintain, and support the features and functionality of the App; to support advertising related to the App or offered through the App; to assess and monitor network traffic, technological demands, and demographic data associated with the App; to detect or prevent fraudulent or unlawful activities; to comply with applicable laws; and to otherwise plan for and enhance the App.
If you terminate your account with the App, GIG BOSS may delete and/or archive your personal information. Once your account is terminated, GIG BOSS cannot promise the continued existence or accessibility of any personal information you stored with or provided through the App. Unless you request deletion of your personal information (as discussed in Section 4, “How You Control Your Information”), GIG BOSS may retain your information as needed to maintain the functionality of the App, to ensure continuity of the App for other users, and as otherwise required by law.
2. How Gig Boss Shares Information
GIG BOSS may share your information with affiliates, vendors, or consultants who perform services for GIG BOSS or who otherwise assist with the App. Those affiliates, vendors, or consultants may assist GIG BOSS with its operations relating to analytics, technology, marketing, management, accounting, and other functions. GIG BOSS may share your information for the purpose of displaying advertising to you.
Under no circumstances will GIG BOSS collect information from your contacts and/or address books to build a customer database for its own use or for sale or distribution to others. GIG BOSS may share anonymized or de-identified information for its own business and marketing purposes, but GIG BOSS will not use such anonymized or de-identified information to build or recreate individual user profiles.
GIG BOSS will disclose information when required by law, including but not limited to demands for disclosure by subpoena, by a government agency, or by law enforcement.
3. How Gig Boss Protects Information
GIG BOSS values the security of your personal information and uses commercially reasonable safeguards to protect the integrity and security of your information. No security measures are perfect and GIG BOSS cannot guarantee that your personal information will be shielded from a security breach. In the event GIG BOSS determines that your personal information has been compromised by a security breach, GIG BOSS will take reasonable steps to notify you and investigate the breach.
4. How You Control Your Information
You have the right to withhold your information from GIG BOSS. If you withhold information that impairs or prevents GIG BOSS from providing or supporting the App, you accept the risk that the App will not function. You can immediately stop GIG BOSS from collecting further information by uninstalling the App from your device. After you have terminated your account with the App, you may request deletion of your personal information by sending an e-mail to GIG BOSS at privacy@gigbossapp.com.
You have the ability to modify your information by accessing your account with the App. GIG BOSS will retain your information for as long as your account with the App is active and/or to the extent needed to support the App.
To the extent GIG BOSS displays advertising to you, you may be able to opt out of certain forms of interest-based mobile advertising. For more information, visit the Network Advertising Initiative at www.networkadvertising.org/choices. You may be able to further limit interest-based mobile advertising through the settings on your device by selecting “limit ad tracking” on Apple (iOS) devices or “opt-out of interest based ads” on Android devices. If the App incorporates display advertising through Google Analytics, you may be able to control your advertising preferences by visiting the Google Ads Preferences Manager at www.google.com/ads/preferences.
5. Children’s Privacy
Because a primary purpose of the App is to foster communications by and between friends, workers, and colleagues about jobs and job opportunities, the App is only intended for use by persons who are legally eligible to work under governing law. For its typical and ordinary uses, the App should be limited to use by persons age 18 or older. If the App is used by persons age 15 through 17, such use should only occur with significant parental involvement and approval.
The App is not directed to persons age 14 or younger. GIG BOSS does not endorse or recommend use of the App by persons age 14 or younger and GIG BOSS reserves the right to immediately terminate the App and to review and/or delete personal information collected from such persons. Under no circumstances will GIG BOSS knowingly collect personal information from persons age 14 or younger. If you have reason to believe that GIG BOSS has collected personal information from persons age 14 or younger, please contact GIG BOSS through the App or by e-mailing adam@gigbossapp.com.
6. Third-Party Software Development Kits; Access to External Websites and Services
The App may employ third-party software development kits (SDKs) or links to external websites and services (collectively Nonparty Resources). GIG BOSS will undertake commercially reasonable efforts to ensure these Nonparty Resources provide the same or equal protections for your personal information as you receive from GIG BOSS under this Privacy Policy. GIG BOSS cannot guarantee the privacy or security of information once it is submitted to Nonparty Resources, and you accept the risk of accessing and/or submitting your information to Nonparty Resources.
7. Changes to This Privacy Policy
GIG BOSS in its sole discretion may modify or update this Privacy Policy from time to time. You should periodically review this Privacy Policy. In the event this Privacy Policy is modified, the “last modified” date will be changed to reflect the date of the modification. If GIG BOSS makes material changes to this Privacy Policy, GIG BOSS will notify you through the App or by other commercially reasonable means.
8. Governing Law
By using the App, you consent to GIG BOSS’ use of your information as set forth in this Privacy Policy. You further accept and agree that any disputes arising out of or related to this Privacy Policy will be governed by the laws of the United States and the State of Minnesota. You further accept and agree that your use of the App is governed by the Gig Boss Terms of Service www.gigbossapp.com/terms-of-service. If you dispute or disagree with any term of this Privacy Policy or the Gig Boss Terms of Service, you agree that you will not rely on the App and will immediately cease all further use of the App.
